Services
For purposes of a DUI, drugs include illegal drugs and any substance that impairs a person including over-the-counter medicine, cough medicine, prescription medication, medical marijuana and even herbal supplements. Although marijuana has been decriminalized in California, it remains illegal to drive if a driver is impaired from using marijuana.
We strive to contact the prosecutor or district attorney's office early. In such cases, the filing deputy may be persuaded to schedule an office conference to discuss the matter between the parties. Often we see prosecutors or detectives with a narrow view of the case or only know a one-sided point of view from the victim.
Post-conviction relief is critically important through an expungement/petition for dismissal which modifies your record. Your record will show that you were arrested and convicted of an offense, but that you are now entering a plea of not guilty and the case against you is dismissed in the interest of justice.

Top notch. Got a DUI with GBI. Courts wanted max sentencing, 5 years prison. Then they wanted 365 days county time. Thomas got the judge to knock it down to 180 days in and 180 days out county time.
Currently out on house arrest until October then work release.

The Law office of Thomas M. Spivack did an amazing job with my case. With COVID-19 I didn’t have to worry about several court dates. Went on the final day and he had my case dropped from a DUI with huge fines, Jail Time, and months of Driving School Classes; to a Dry Reckless. Never heard of a Fry reckless but he did his home work and found an opportunity to reduce my case. Highly recommended to anyone needing a miracle worker. Best experience I’ve ever had at court. He has many years dealing with DUIs and as a 3rd DUI convict I was fearful to what would happen.. he made everything very clear and it felt like he was more of business friend who actually cared to hear my story and was ready to fight for me. Mr. Spivack was my attorney last year. I was referred to him by a church friend. He was outstanding and a real fighter for me. He also worked out the fee for me so I had payments and I was glad to pay him every step of the way. Smartest money I spent and now I don't have a record. I was on the freeway going about 75 and got pulled over by CHP. Blew a 09.%. Hired Mr. Spivack after checking reviews and speaking with him and some other attorneys. He has tons of knowledge and experience clear from our first conversation plus he was supportive and patient. He calmed me in a serious situation. Mr. Spivack persuaded the prosecutor to let me have what they call diversion for community service and got my DMV situation dismissed completely. I won't have a record at all

Do not bother looking anywhere else. Spivack is simply the BEST lawyer. Smoked spice and got really wasted. Spivack got my DUI dismissed. Reduced to reckless. Just paid a small fine and took a short class. Call him if you need a lawyer, he will help you. Made me feel like I was always his top priority.

Restored my life. Gladly gave him his fee because he earned it by protecting me and my future. First DUI. I hired this attorney because I saw great reviews and I had the same experience with him. I was speeding and weaving on the freeway. Cops took my blood by warrant because I refused to do it - not sure what I was thinking at the time, just scared.
