Probate is a legal process in which your property is identified, inventoried, and distributed to your rightful heirs after your death. If you have a will, it contains a written record of what you wish to be done with your property. You have named an executor (usually a relative or trusted friend) who will carry out your wishes through the court-supervised process of probate.
The phrase estate planning is often misunderstood. Most people tend to think that "estate" means a large home with rolling acreage like the one shown on Dallas, and that owners of those kinds of "estates" are the only ones who need concern themselves with estate planning. Actually, estate planning is a term that simply indicates you are thinking ahead and planning to whom your assets will be distributed.
The concepts discussed here apply to all unmarried couples, including gay, lesbian, and heterosexual. According to California law, if you die without a will or other estate planning device, your assets will be distributed strictly to your family members, while your partner will receive nothing. It does not matter how important the relationship with your partner was, or how long-standing.
If you wish to give to charity, a gift can be made during life or as a transfer after death. Gifts can be either given outright or put into a trust with terms designated by you. With proper planning, both lifetime and after-death gifts can be used to benefit you and your estate as well as the charity.
If you have a dependent or beneficiary with a physical or mental disability, you may be very concerned about providing for this person's well-being after your death. However, leaving an outright inheritance may not be the best way to provide for his or her financial security. There are certain government benefits available to the disabled, and an outright gift might disqualify your loved one from receiving those benefits.
