I started Prokowiew Law in 2011 to meet the diverse legal needs of people with disabilities. My interest in disability law began around 1996 when his friend revealed her own physical disability. As I witnessed her navigate a world primarily designed for those without disabilities, my passion for disability equality grew.
At times a person with a disability may lack the capacity to make certain decisions for themselves, including medical ones. This is where a guardianship can come into play. When a person turns 18 years old, their parents can no longer legally make decisions for them.
If a person has a disability that is so severe as to impede their understanding of their own medical issues, there is still not a presumption that person has capacity, and only a judge can determine otherwise.It is my job to work with the interested person, often the parent of a child who is or will soon be 18, or the adult child of an elderly parent, to secure that decision-making ability for them.

My very first case when I earned my license was a gentleman who had worked hard and for a long time in his chosen field. He didn't anticipate that his disabilities would lead to extreme pain and an inability to do his work. When that happened, he called me. I represent claimants at all stages of the Social Security Disability Insurance Benefits process, be it the initial application stage, the reconsideration stage, or at a hearing.
A parent with a special needs child can feel a lot of stress as they consider how best to care for their child after mom or dad dies. That concern leads me to expand my disability practice to include special needs estate planning. It's important for the parent to strategically approach the question of how to leave funds for a special needs child while also leaving the child with access to public benefits.

Once I joined the Disability Law Center (DLC) and began taking intake calls, the stories I heard covered a broad range of issues from parents concerned about the educational needs of their special needs children to adults with disabilities who had lost their jobs or their housing as a perceived result of discrimination based on disability.
