Probate is generally thought of as the process of transferring assets of the deceased to their heirs under court supervision. If the decedent died testate (meaning with a will), the heirs are those named in the will. If the decedent died intestate (meaning without a will), then the heirs are those spelled out by the Ohio Revised Code and typically include the spouse or spouse and children.
