Probate is generally thought of as the process of transferring assets of the deceased to their heirs under court supervision. If the decedent died testate (meaning with a will), the heirs are those named in the will. If the decedent died intestate (meaning without a will), then the heirs are those spelled out by the Ohio Revised Code and typically include the spouse or spouse and children.
Estate planning is not just for the super wealthy trying to avoid estate taxes. In fact, for the ordinary person, estate planning is much more about providing for minor children in the event of a tragic accident or making sure a spouse or loved one can appropriately care for you if you are mentally or physically incapacitated.
From zoning ordinances to private easements and from the neighborhood homeowner association to the nuisance neighbor next door, there is no shortage of regulations impacting your property. Understanding your rights and your obligations regarding owning and protecting real property can make all the difference.
