Estate Planning is the process through which a person sets goals and parameters for how their family and other beneficiaries are to be take care of at his or her death, dependent on many factors (including the personalities of their family members, the value of their assets and the estate tax laws) and then executes the proper documentation to achieve those goals.
Estate administration is the court proceeding through which a deceased individual's assets are transferred to the beneficiaries named in his will (testate administration by an executor) or his heirs as determined under state law if he has no will (intestate administration by an administrator). Issues may arise among family members or beneficiaries where will contests or trust contests are filed and litigation ensues.
Guardianship is the court proceeding through which an individual is found to be disabled or incapacitated (unable to handle his or her financial affairs, or unable to make personal decisions for himself or herself such as medical care decisions), and a guardian of the estate or guardian of the person of the disabled individual is appointed.
