Bankruptcy is a difficult and demanding process. Often, when bankruptcy becomes necessary, it is the result of some unforeseen event or external circumstance. The American Board of Certification is a nonprofit organization dedicated to serving the public and improving the quality of the bankruptcy bar.
Chapter 7 is designed for debtors in financial difficulty who do not have the ability to pay their existing debts. Debtors whose debts are primarily consumer debts are subject to a "means test" designed to determine whether the case should be permitted to proceed under Chapter 7 (if the debts are primarily non-consumer debts then the debtor is not subject to a "means test").
Chapter 11 is designed for reorganization of a business but is also available to consumer debtors. Its provisions are quite complicated and any decision by an individual to file a Chapter 11 petition should be reviewed with an attorney. What is the process for filing Chapter 11? Either the debtor or its creditors may file a petition for Chapter 11 bankruptcy protection, the latter route referred to as an involuntary petition.
Chapter 12 is designed to permit family farmers to repay their debts over a period of time from future earnings and is similar to Chapter 13. The eligibility requirements are restrictive, limiting its use to those whose income arises primarily from a family-owned farm. I would like to leave a positive note out here to other parents going thru custody battles or separations/divorces that have children involved. Mr. Beresko and his team have been more than an absolute dream to work with. It has been nothing but a positive experience in our life and our child's life. Divorces, Custodies, etc. can all get out of hand and get dirty, ugly and very negative, very quickly. But with this team, they have always been supportive, encouraging to everyone involved and always helping to find and work thru the best scenario and guess what!!!! All for the benefit of the child

Review: To say Mr. Beresko and his team are amazing is an understatement. I am thankful for him and all who worked so hard to get me everything I wanted. I am thankful that he took my case even when several attorneys turned me down. It was going to be an uphill battle. They always returned my emails and/or phone calls promptly. Mr. Beresko always made me feel like I was his number one client. He would reassure me that I was a good mom and that I would not lose my kids. He was okay, but he didn't have me leaving with much confidence in his abilities. He didn't give me much information, and his retainer fee rose after speaking with him.
I spoke with him for about an hour, and after I left I was pretty sure he didn't care either way if I hired him. So since I left feeling like that, I chose against him.

I was involved in an automobile accident when I was visiting Shreveport, LA. Mr. Beresko and his staff were so helpful and kind. Ponya, the office manager was incredibly professional, timely and quick to answer all my questions regarding the questions about the accident I was in. Mr. Beresko was super helpful with helping me understand what I needed to do in order to get my insurance company and auto repair done to my car. I cannot recommend this firm enough!

Alfred Beresko and staff worked tirelessly in a four year long very contested custody case that went to trial.
