In today's economy, many individuals and families are faced with overwhelming debt, are struggling to stay afloat, and living from paycheck to paycheck. You, a friend, or someone you love may have been affected by the housing market crash, being laid off, having had hours reduced at work, medical debt, or any numbers of problems.
This is the most common type of bankruptcy filed, and is generally the most straightforward and least time consuming. It is known as a "Liquidation Bankruptcy" or a "Straight Bankruptcy". For the most part, a Chapter 7 Bankruptcy allows you to discharge most of your debt and takes approximately 3 to 4 months to complete from the time you file.
Although a Chapter 20 Bankruptcy does not technically exist, bankruptcy attorneys and the bankruptcy courts have recognized a Chapter 20 bankruptcy as the combined filing of a Chapter 7 Bankruptcy followed by a Chapter 13 Bankruptcy. The primary purpose of a Chapter 13 Bankruptcy is to provide debtors with relief from debt by creating an organized and supervised repayment plan in which they can repay as much to creditors as possible and obtain relief from those amounts that cannot be paid.
