A Chapter 7, sometimes referred to as "straight bankruptcy, " is ideal for those whose debt is mainly unsecured and who have a minimal amount of assets. Most unsecured debts can be discharged through chapter 7, with some exceptions, such as student loans, criminal fines, and most taxes. If you are burdened with unsecured debt, such as credit cards or medical bills, a chapter 7 bankruptcy will discharge, or cancel, the bulk of those debts.
Chapter 13, sometimes referred to as a "wage earner" plan because you must be earning an income or receiving some other form of regular income such as Social Security in order to participate, involves restructuring and a 3-5 year debt repayment plan. In a chapter 13 bankruptcy, rather than canceling your debts altogether, you are paying back your creditors at least a portion of what they are owed.

I highly recommend Rod Miller as an attorney. He helped stop creditors from calling at all hours, and even stopped the bank from reposessing my car so I could still get back and forth to work. He has also helped family members with divorces (I know it is sad). He is truly caring and non-judgemental. I immediately felt more comfortable when I had to file my bankruptcy. I had went to two other attorneys, and they made me feel ashamed that I was in financial trouble. I would recommend him to anyone who needs help.
