I started in criminal law out of passion. I started in Family Law out of necessity. After my own personal experiences in Divorce court, I realized that I have something to offer in the field of Family Law. I saw lawyers who lacked trial experience struggling with their courtroom procedure. Doing everything they could to avoid litigation, even when it was in the best interest of their client.
Florida is a No Fault Divorce state. What this means is, absent some extremely limited circumstances, the reason that you or your spouse wants a divorce is irrelevant. The Court will not hear the reasons for the divorce. As long as one Party swears that the marriage is irretrievably broken and that no amount of counseling is going to fix it, a divorce is going to take place.
In cases where the parents of the child were not married the Father of the child has no legal rights toward the child until they legally establish their rights through a Paternity action. Although a Father's name on the Birth Certificate is evidence of Paternity, this does not establish any legal rights toward the child.
Domestic Violence is never acceptable. In addition to criminal prosecution, domestic violence can lead to Injunctions and serious consequences in Divorce and Family Law matters. If you are a victim of Domestic Violence the first thing you need to do is call the police and report it. Too many victims wait to call the police.
Equitable Distribution is the term in Florida used for the division or the assets and debts of the marriage. The premise of Equitable Distribution is that the division of assets and debts be fair and just. This does not necessarily mean 50/50 or equal, but it does mean that the presumed starting point is 50/50.
