An estate plan is an extremely powerful tool that allows you, not a probate court, to determine how your assets will pass or how your medical decisions are made. However, estate plans are not just for end-of-life issues because a well-designed plan directs other matters throughout your life. It is imperative for you to have an established and comprehensive estate plan.
Managing probate and trust administration of an estate is complex work that requires strict attention to the intricate details of the law, tax code, and adherence to the terms of the last will or trust agreement. As a personal representative of a probate estate, or a trustee of a trust, or both, you can be held personally liable for any mistakes you make in the performance of your fiduciary duties.
A pour-over will is an estate planning tool used to ensure the wishes you have documented in your trust agreement are followed even if something were defective. For example, a defect can occur if you were to forget to fund your trust properly, title a new asset in the name of the trust, or if something were to go wrong with the trust itself that made it legally inoperative due to a failure of the document, or a change in the laws.
A will is typically just one part of a properly designed estate plan. If you do not have a will, your estate will pass "intestate" according to the laws of California. However, even if you have a will or choose to have one drafted on your behalf, there are a few things you should know. If you have minor children, a will is used to determine guardianship if both parents have passed.

After searching on the internet for a honest estate attorney with integrity I came across Jim Flipping and after speaking to him on the phone I immediately I knew I had found the right attorney I was looking for. Not only did Jim meet my prerequisite of integrity and honesty but also provided helpings of likability a patience. I thought his initial quote was a wee bit on the high side after comparing estimates that covered the paperwork cost and preparation by non legally trained writers. I was lookIng for someone to help me with my living trust and all it's various components. It was partlly because of their close proximity that I chose the Filippi Law Firm, but I am very happy I did. Jim is a very down to earth and personable person which put me at ease right away. But make no mistake, he is also a very competent and extremely thorough attorney. He and his paralegal wife took very good care to see thaat I felt welcome me and understood every aspect of what was being done and why.
