An estate plan is something you should have in place at all stages of your adult life so that your wishes regarding the transfer of property to your heirs, appointment of guardians of your children (should that become necessary) and other issues (such as burial and funeral preferences) are honored and conducted as smoothly as possible.
In a family business, a single family controls business activities such as leasing property, strategic planning, marketing of products and succession planning. There are also financial transactions to be considered, including asset purchases, raising capital for business expansion and sales, mergers and acquisitions.
Divorce proceedings in and of themselves can be complicated and challenging matters to deal with. When business ownership is involved, divorce proceedings can become overwhelming issues to deal with alone. Fortunately, with the assistance of an experienced lawyer, you may be able to find the resolutions and closure you need to move on, without harm befalling your business or your financial well being.

A will has legal effect only upon death and thus can be amended or revoked anytime during the testator's life as long as the testator is mentally competent, not being "unduly influenced" and has not agreed in a contract to not amend the will.
Because a will only has legal effect upon death, it is important to appoint persons to act on your behalf during your life if you become mentally or physically incapacitated, which is accomplished using powers of attorney, which are discussed below. Many married people believe their spouse would have the right to act for them in a legal capacity if they become incapacitated without these powers of attorney, but that is not correct.

David Franklin has helped me form a limited liability company to protect my assets, create an estate plan and create commercial leases and contracts. I have worked with him for more than a decade in both business and estate planning matters.
He is extremely smart, caring and diligent. He was responsive, timely and consistent in his approach.
I strongly recommend his services in all of these areas of law.

David Franklin handled my father's estate. The estate supposedly signed a piece of land over to my brother and myself, but David Franklin did not do the paperwork correctly and my sister still owns the land and he is refusing to to do the neccessary paperwork that he has already been paid for to make this right. I would not recommend this attorney for any estate planning as it is my opinion that he does not care for the inheritors.
