Per Se- this is the type most people think of when they hear DUI/DWI. The state has to prove beyond a reasonable doubt that you drove while your alcohol concentration was 0.08 grams or more. Less Safe-in some cases this charge can be reduced to reckless driving. The state must prove beyond a reasonable doubt that you were driving while under the influence of alcohol to the extent you were incapable of driving safely.
In Georgia, a felony is most commonly defined as a crime punishable by imprisonment for more than twelve months. It can also mean a crime punishable by death or by life in prison. If you are convicted of a felony, spend a significant amount of time in prison and paying a large fine are not the only penalties you are facing.
Many traffic offenses carry heavy penalties. While a simple speeding ticket can be handled by mailing the fine into the court clerk, not all traffic cases are so easily dealt with.
