Cucinelli Geiger, PC is a boutique law firm that focuses on Elder Law, Estate Planning, and Special Needs Planning. We listen first, to understand your unique needs and goals, so that we can provide the advice that is best for your particular situation. We work with seniors and their families to provide legal advice and legal services specifically for your unique financial and medical situation.
We also help families who are planning for disabled adults or children. None of us really likes to think about our own mortality or the possibility of being unable to make decisions for ourselves. This is exactly why so many families are caught off-guard and unprepared when incapacity or death does strike.

Believe it or not, nearly everyone has an estate. Your estate is comprised of everything you own- your car, home, other real estate, checking and savings accounts, investments, life insurance, furniture, personal possessions. No matter how large or how modest, everyone has an estate and something in common-you can't take it with you when you die.
A fiduciary is the trustee, executor, conservator or power of attorney of a loved one's estate. The fiduciary is responsible for overseeing all of the complex legal and financial issues that follow managing someone else's assets. Cucinelli Geiger, PC provides professional fiduciary services - which means that we are here to lean on, educate and be financial advocates during your time of need.
A guardian is defined as someone who is legally responsible for the health care of a person who has been declared incapacitated by a court. A conservator, on the other hand, is someone who is legally responsible for managing the finances of a person who has been declared incapacitated by a court.
The process starts with a petition filed in the city or county where the respondent lives, or where she lived immediately prior to moving to a nursing home, assisted living facility or other institution. Then, a hearing will be scheduled to prove that a guardianship or conservatorship is necessary and who should be appointed as a guardian or conservator.

Individuals who are faced with the need to enter a long-term care facility such as a nursing home or assisted living facility or who are being provided with similar care at home face the very difficult issue of how to pay for that care. Nursing home care can cost $8,000 to $12,000 per month.
While some have provided for this need with long-term care insurance and a fortunate few are able to afford their care without other assistance, most people find that long-term care expenses pose the danger of significantly and quickly depleting their life savings.

I first met Ms Cucinelli when she was appointed Guardian ad litem for my mother when I was seeking guardianship. Later she was pulled in to mother's affairs by a man who was stalking my mother. I subsequently recommended her to prepare a group of legal documents for my neighbor and friend. In every single instance of dealing with Ms. Cucinelli she demonstrated the kind of expertise, skill, and compassion one wants in family legal situations. She is simply everything one wants in an attorney, especially for often-painful legal issues around family and the elderly.

Cucinelli-Geiger was recommended to me by an excellent attorney in Manassas, Virginia whose schedule was too full to help me. Cary Cucinelli and Valerie Geiger have provided excellent help to my brother, who was in very poor health and under nursing care. A local friend was acting as my brother's healthcare and financial power of attorney, and the burden of those duties was becoming too much for her. Cucinelli-Geiger efficiently unloaded the friend from a multitude of administrative duties, while keeping her fully informed. As it happens, my brother passed away within one month, and C-G is
