As a divorce attorney with more than 40 years of family law and mediation experience, I have seen firsthand how challenging the divorce process and resolving civil disputes can be for most people. Often people are emotionally overwhelmed at the exact time when they need to be thinking clearly and making sound decisions that will shape their futures for years to come.
In collaborative divorce, each spouse has an attorney who helps the parties reach an agreement, rather than engage in an adversarial process. In some cases, a mental health professional and/or financial planner are utilized to reduce the costs and address all the needs of the parties. A collaborative process divorce involves each spouse securing legal representation.
Divorce is not an easy process for anyone involved. The act of separating two lives that have grown together legally, financially and emotionally can be complicated. People often have very specific ideas about how they want to resolve the questions posed during their divorces. This can lead to conflict.
Many times after a custody or support order is entered, whether it be a divorce case or paternity case, circumstances change which require changes in that order. For instance, circumstances may change such that the parenting schedule needs changed. There also may be a significant change of circumstances which requires change in the amount of child support.
