A Will is a document, executed with certain statutory formalites, by which a person specifies who is to be the beneficiaries of his property (either outright or in trust) and who is to carry out his instructions for distribution of that property. While certain states, such as California, recognize holographic wills, Oregon does not.
Probate is perhaps the most common legal process by which a decedent's heirs are identified, debts and taxes are paid or contested and assets are legally transferred to beneficiaries. Probate is not always necessary. Our office advises individuals on whether or not to commence probate and we represent individuals who petition to be appointed as Personal Representative.
Probate is the legal process by which a decedent's affairs are concluded and property belonging to the decedent is distributed to those entitled. As an attorney licensed in California, Bruce Thompson can file probate proceedings in all California counties. It is not uncommon for an Oregon resident to be the nominated personal representative or be the next of kin of a decedent who lived in California.
