A party who is the victim of domestic violence should seek immediate intervention from law enforcement to obtain an emergency protective order. The party can then apply to the Court for a temporary and permanent restraining order depending upon the circumstances of the case. The party requesting a permanent domestic restraining order will need to prove by a preponderance of the evidence that abuse has occurred as defined under the Family Code.
California is a no-fault divorce state. This means that either party in a divorce case is entitled as a matter of law to have a divorce as long as certain jurisdictional requirements are met. Neither party has the ability to prevent the other party from obtaining a divorce unless there are legal grounds for doing so.
Parents file paternity actions in cases in which they were never married, but they have one or more children together. Parents will file what is commonly called a "paternity case" to obtain orders relating to custody, visitation, child support, name change, determination of paternity, and other related issues.
There are various ways to enforce existing orders if a party has failed to do something they have been ordered to do. For example, the other parent may have failed to pay child support as ordered by the Court. Your ex-spouse may not be paying the Court-ordered spousal support or has failed to maintain life insurance coverage that was ordered by the Court.
