Despite its inevitability and universal reach, death is a topic that is difficult for most people to discuss. Most people want their deaths to be a time where their own life is celebrated and their surviving family members are able to come together. Most people do not want their deaths to be a time marked by family squabbling and disputes.
Laws in every state (including Tennessee) presume that a person over the age of eighteen years is fully capable and able to make decisions concerning their personal care and the management of their affairs. In most cases, this presumption continues until the person dies. However, what if an adult is over the age of eighteen years and is incapable of properly caring for him/herself?
We plan for weddings, parties and vacations. People sometimes even plan when they would like to start a family or what trajectory they would like for their careers. However, few plan for serious and unexpected accidents or illnesses that can rob a person of his or her consciousness, ability to think clearly, and/or ability to make rational and independent decisions.
In legal parlance, a "guardian" is an individual who is tasked with the care and management of a child. In other words, a child's guardian makes decisions that affect the health and physical and emotional well-being of the child. What medical care and treatment the child should receive and the medical providers who should provide this care;.
