Wolford Wayne LLP is a tenant's rights law firm dedicated to representing Bay Area tenants. When a tenant is forced to move out of their home due to poor living conditions, mold/mildew, pest infestations, or harassment this is known as a "constructive eviction." Our office represents Bay Area tenants in disputes that arise out of a landlord's failure to repair and maintain their apartment or home.
One of the most common issues we see is when a tenant is forced to move out of their home which is known as a constructive eviction. In San Francisco, Oakland, and other cities with local Rent Ordinances, a tenant has been constructively evicted when a tenant is forced to move out of a rent-controlled home due to a landlord's actions or inactions.
Our office represents Bay Area tenants in disputes that arise out of a landlord's failure to repair and maintain their apartment or home. In California a landlord has a duty to provide their tenants with safe, sanitary housing. Unfortunately, while landlords are obligated to respond to repair requests straight away landlords are not always good about this.
It is unlawful for a landlord to harass a tenant. Illegal Harassment can take many forms. Tenant harassment includes: removing /taking away services (such as cutting off heat or hot water), refusing to make necessary repairs, threatening tenants with eviction or harm, or attempting to force a tenant to vacate their apartment.
A wrongful eviction occurs when a landlord evicts a tenant in violation of a local rent ordinance or California State Law. In San Francisco, Oakland, Berkley and other cities with a local ordinance a landlord can only evict a tenant with a "just cause" for eviction. Tenants who have been wrongfully evicted may be entitled to substantial monetary damages.

Last October, the building in which I'd lived for fifteen years was purchased by a developer landlord, who wasted little time in offering to buy me out of my rent-controlled apartment. We contacted Daniel Wayne when we didn't get all of our security deposit back. And felt that we were being wrongly charged for cleaning and back rent. He gave us great feedback on our letter to the property management company and information on our options around small claims court. Daniel is compassionate and understanding, his advise is grounded and sound.
