Believe or not, you have an estate. As a matter of fact, nearly everyone does. There is a common misconception, unless you are very wealthy, you do not need Estate Planning. Your estate encompasses everything you own-your home, car, checking and savings accounts, investments, life insurance, debts and personal items.
Elder law covers the broadest spectrum of various traditional areas of law such as contracts, health care decision making, criminal fraud, abuse, eligibility long term care (either long term care insurance or Medicaid), incapacity, retirement benefits, nursing home care and variety of other topics relevant to the senior client.
Estate planning with retirement benefits is a challenging area dealing with interface of estate planning and retirement benefits. The paramount concern of many clients revolves around the minimum distribution rules and regulations. In a major decision, the Supreme Court ruled-Inherited IRA's are not considered protected retirement funds.
Asset protection trusts are created to protect assets from long-term care costs, creditors, predators (divorce, accidents, business failures, lawsuits etc). Asset protection also includes the protection of assets from one's own poor decision making, or fear of not having the mental capacity to manage the assets you have accumulated.

Attorney Acosta did an excellent job carefully walking me through all of my options, clearly identifying the pro's and con's. I chose a Living Trust, and she was unbelievably thorough throughout the process. I'm extremely happy with my situation now, and know my children will be very well cared for because of the Trust she built for me. I highly recommend her.
