Bankruptcy is a legal proceeding in which a person who cannot pay all of his or her bills can obtain protection from creditors and eliminate his or her debts in whole or in part. Bankruptcy is provided for in the Constitution of the United States. The ability to file bankruptcy is established by federal law, and all bankruptcy cases are handled in federal court.
Chapter 7 is a liquidation proceeding. One way to understand this procedure is to think of it in terms of a bargain that you make with the Bankruptcy Court. When a person files a chapter 7 they are in essence telling the Bankruptcy Court that they are willing to turn over to the Bankruptcy Court all of their nonexempt assets (those assets that are in excess of the things that are allowed to keep when they file bankruptcy).
Chapter 7 is limited to those individuals who are reasonably unable to pay their debts. Your ability to reasonably pay your debts may be limited by the "Means Test" that is part of the bankruptcy process.
Not every debt is eligible to be discharged in a chapter 7. The debts that most commonly cannot be discharge in bankruptcy include support obligations, recent taxes, and student loans (unless a hardship as defined under the law can be proven in court).

My clients often asked me which chapter, 7 or 13, is the better one to file? The answer is neither is better, they are just different. The goal of any bankruptcy is to obtain a discharge, a court order that releases you from your indebtedness. Chapter 13 and Chapter 7 are two different ways for a consumer to achieve that goal.

Kept receiving letters from Marshall Cohen LLC & his staff to hire them for bankruptcy. Decided to go ahead & set up a consultation. Went in & had an appointment at 2pm. Marshall came in & told me there would be a wait due to he had someone else squeezed in. Ended up waiting 15 minutes before being seen. When he came in he was polite but did not do anything as discussed over the phone. Didn’t really explain the bankruptcy process as I told him I wanted to understand how it worked before I jumped in.
