More than 19% of independent contractors in the construction industry are misclassified. Misclassification of employees happens across various professions where organizations prefer to outsource their core businesses to "independent contractors." Many employers in Long Beach and the larger California state misclassify employees as independent contractors to circumvent their responsibilities towards their employees.
Under California's labor laws, 1099 independent contractors do not have a right to meal and rest breaks. These labor laws have caused many employers in Long Beach to misclassify their employees as independent contractors for them to avoid providing them with meal and rest breaks. By misclassifying them, they reap huge profits since they reduce their management and production costs.
Wrongful termination claims arise from situations that involve employees firing their employees without a valid reason. The Workers Compensation Group in Long Beach helps 1099 independent contractors (among other employees), to file such claims. Courts allow plaintiffs to bring such lawsuits, provided they have a legal basis.
Every year, several California exempt employees are victims of overtime laws violations made by their employers. For instance, the biggest assumption employers make is that any salaried/exempt worker is not eligible for overtime pay. This is not the case. A significant number of salaried workers are either non-exempt or do not fall within the specific exemptions stipulated in the Fair Labor Standards Act (FLSA).

Temporary and permanent workers must familiarize themselves with these laws and any amendments. This understanding will save them from being taken advantage of by unscrupulous employers in the state.

I needed an aggressive attorney to help me with my case because the last one was trying to get me to take a bad compensation deal. What a clown the last guy was and I wasn't fallin for it, no way no how. I found Justin spoke with him on the phone for about 20 minutes and then met with him to talk further, he loved my case and said I made a great choice not taking the last deal.
