Bankruptcy Exemptions: To begin to understand chapter 7, it is important to understand the law on exemptions. Basically, when you file a chapter 7 bankruptcy, the chapter 7 trustee becomes the owner of your property. Each state, however has a list of property you can exempt from this result. Hence the terms, exemptions.
Chapter 13 is a reorganization of debt for individuals, couples and some small sole proprietorship's. In chapter 13, you make a payment to the bankruptcy trustee each month, and the bankruptcy trustee distributes this money to your creditors. In our state, a mortgage company has two options in foreclosing on real estate: they may either file for "Judicial Foreclosure" by filing a lawsuit, or they may start a "Non-Judicial Foreclosure", which begins by the filing of a Notice of Default with the county recorder. The processes are technical and you have different rights under each method of foreclosure, all of which is beyond the scope of this article.

Called Sam for what was described as a "free" consultation. Within five minutes of speaking, he told me if it was truly a free consultation, he would go out of business himself. Then he hung up on me. Ridiculously unprofessional. Make sure to bring money with you to pay for your "free" consultation.

Sam and his wife Beth are the best choice we've ever made when it came to feeling stuck with heavy debts.

But not to fear! My wife and took a trip to his Torrance office and made a anxiety free transaction and a interesting conversation with lots of good humor.
One month later a trip to the hearing in downtown which was much better than we expected.
Then three months later the discharge came.
Do yourself a favor and hire Sam to deal with your bankruptcy, you won't be disappointed.
