You will save time and money, and usually accomplish better results, by settling your case amicably with the other party. However, this is contingent on both parties' willingness to cooperate in the process and access to the paperwork needed for you and your attorney to make informed decisions regarding your case.
Whether a petition to divorce or separate is filed, you must ask the court to resolve all issues between you. The biggest difference between a divorce and separation judgment is one line item which addresses your marital status. In a separation, your status changes from married to legally separated.
Sometimes clients and attorneys have very different ideas, at least initially, about the best approach to take in a particular case. For example, should a cooperative and friendly approach be taken or should an aggressive and more rigid approach be taken. Should you compromise as much as possible or are you creating a bigger "monster" by doing so.

I was told at my consult that she had years of experience, she does not perform as a professional attorney. Her staff failed to properly file my case documents, they withheld documents from opposing counsel and same documents were requested multiple times to resubmit. I was charged multiple times for same documents. I wasted time and money on this attorney. She didn't handle either of my 2 cases in a professional manner. I was charged for her to review how to submit documents to the court, that was never completed or filed. I feel this attorney preys on people who need advice and direction- I failed

Despite the complications involved (I am from out of state), Sarah sounded confident that she could get sole custody for me. And she did. She and Mesa were always there to calm me down when this case made me anxious, they made sure I understood the legal processes at work and that I understood my options. This attorney is the reason people dont trust lawyers. She handled my divorce and had me take off work to show up in court just to tell me "oops! my bad. court is tomorrow,not today." then charged me $300 for her mistake. Then when you set up payment with her, she makes up her own amounts and they never match the bills and she REFUSES to explain her figures or send out print outs of them. When she gets the payments, she sends out threats of sending your account to collections within days of recieving payment. You would be better off handling your own legal matters over letting her near
