A trust is a legal arrangement through which a person designates assets to be handled in a certain manner, usually by themselves at first, but once the person passes away, then by a trusted relative.
Often times, when a person whom created a trust becomes incapacitated or dies an alternate individual must act as 'Trustee', take control of Trust assets, and follow the Trust document to manage the individuals care and/or distribute to the beneficiaries. The amount of work required for each type of trust varies considerably.
Conservatorship proceedings are for the protection of elders, while guardianship proceedings are for the protection of minors. When an elder (or "dependent adult") is mentally or physically unable to take care of his or her needs, then it may be an appropriate time to consider establishing, what is known as a, 'conservatorship'.
Since 2001, Eric started as a paralegal, employed in a firm that focused strictly in the fields of trusts, conservatorships, probate and estate planning: an area of law guided not only by the probate code and the cases interpreting its chapters, but also by family history and dynamics of the parties, by conflict, by equity, and by the ever-fluctuating perspectives of the judiciary.
