There is often a lot of confusion surrounding a charge of assault and/or battery. While many people are charged with both, the truth is that these are two separate charges. Assault is defined as an unlawful attempt with ability to commit violence on a person. Battery, on the other hand, is defined as the unlawful use of force upon a person.
